Criptomoedas e desafios de regulação na República Democrática do Congo

RESUMO
O advento das criptomoedas no setor financeiro suscita um vivo interesse em todo o mundo, nomeadamente por parte das empresas e dos particulares. Isto deve-se em especial ao potencial destas moedas virtuais suscetíveis de complementar, ou mesmo substituir, instituições estabelecidas de longa data (como os bancos comerciais e os bancos centrais) por um novo sistema, integralmente descentralizado, assente na cadeia de blocos e na tecnologia de registos distribuídos que lhe é intrínseca. A perspetiva da regulamentação das criptomoedas tem igualmente todo o seu lugar na República Democrática do Congo, onde a economia nacional já dolarizada pode, no futuro, ver-se ainda mais « invadida » pelas criptomoedas. Assim, a presente contribuição tem por objeto facilitar a compreensão das tentativas de regulamentação em curso pelo mundo, a respeito das criptomoedas, e relacioná-las com o contexto congolês, a fim de descobrir as bases possíveis de uma regulação nacional adequada.

ABSTRACT
The advent of cryptocurrencies in the financial sector is attracting a lot of interest across the world, particularly from businesses and individuals. This is particularly due to the potential of these virtual currencies to complement – or even replace – long-established institutions (such as commercial banks and central banks) with a new, fully decentralised system based on blockchain and intrinsic distributed ledger technology. The prospect of cryptocurrency regulation is also relevant in the Democratic Republic of Congo, where the already dollarised national economy may – in the future – find itself further « invaded » by cryptocurrencies. Thus, the purpose of this contribution is to facilitate the understanding of current attempts at regulation around the world, regarding cryptou0002currencies, and to relate them to the Congolese context, in order to discover the possible bases for an appropriate national regulation.
